GENERAL CONDITIONS OF THE CONTRACT

These general conditions regulate the tourist accommodation contract between the contracting person (hereinafter, also the user) and DONAMAR RESTAURACIÓN, SL (hereinafter HOTEL CAN CLOTAS) CIF B10976090, registered office at Masia Can Clotas, Ctra. GIP 5101, KM . 5 (GIRONA), registered in the Mercantile Registry of Barcelona, Volume 48416, Folio 127, Sheet No. B-583238, Inscription 1a, email info@canclotas.com and telephone +34 630101063.

HOTEL CAN CLOTAS is duly registered in the Tourism Registry of Catalonia, with registry identifier PG-000729, control digit DC-43, category SC MASIA.

ACCEPTANCE OF THE GENERAL CONDITIONS

By contracting our services offered on this website, the contracting party expressly states that they have read, understood and unreservedly accept these general conditions, as well as any particular conditions that may be established. All the general conditions will be permanently available to Users prior to contracting and may be stored, reproduced and printed in the current version at any time.

These conditions will have an indefinite validity period, HOTEL CAN CLOTAS reserving the right to modify them unilaterally, without this affecting the services or promotions that were contracted prior to the modification, for which reason users are recommended to read carefully each time you access this portal, meaning those that appear published on it at any given time are valid.

The contract will not be archived. It will be written in Spanish, and in consumer relations that take place in Catalonia, also in Catalan.

RECRUITMENT PROCEDURE

  • Step 1. Selection of the room. You must indicate the day of arrival and departure, number of people per room and click on "Search". The available rooms will be shown below, and you must choose the one that interests you, number of occupants, rooms and the diet you prefer from those offered.
  • Step 2. Personal data. When continuing with the reservation, you must provide the personal information requested, including a credit card to guarantee the reservation. Once all the requested fields have been filled in, you must press the "confirm reservation" button for the data entered to be sent.
  • Step 3. Confirmation of the reservation. Once the data is received after clicking the "confirm reservation" button, you will receive an email confirming the reservation.

TECHNICAL MEANS TO CORRECT ERRORS

During the reservation process and before pressing the button to proceed to confirm the reservation, the user may correct any error and will be prevented from continuing if all the information requested is not provided. Also before proceeding to confirm the reservation, the user may change the content and even cancel it in its entirety, being able to go back to the previous screens to make the appropriate rectifications.

CAPACITY OF THE ACCOMMODATION UNITS AND SPECIAL CONDITIONS FOR USE OR ENJOYMENT OF THE ESTABLISHMENT

The maximum legal capacity of our accommodation units as well as the special conditions and use or enjoyment of the establishment are those indicated in each case on the web before making a reservation.

Pets are not allowed.

During their stay at the hotel, minors must be accompanied by an adult.

WHO CAN HIRE

In order to contract the tourist accommodation services offered on our website, the user declares that they are at least 18 years old.

CANCELATION CONDITIONS

For cancellations made within 48 hours of the arrival date, 100% of the price of the first night will be charged.

Except in high season that will be 5 days before.

The non-presentation will entail the charge of 100% of the stay.

COMPENSATION FOR RESIGNATION OF STAY

It is mandatory to make the payment of the entire stay once the check-in is done, any early departure with notice of less than 48 hours will entail the charge of the nights not made.

PRICES AND OTHER EXPENSES

The prices applicable to each accommodation are those published on the website and applied automatically to which will be added, where appropriate, the additional expenses or services that the client has consented to, configuring the sum of all these concepts the total amount owed. payment in the last phase of the same.

The prices indicated include Value Added Tax (VAT), expressed in the Euro currency (€).

The tax on stays in tourist establishments (IEET) is applicable to people who stay in tourist accommodation establishments in Catalonia over 16 years of age, accruing at the beginning of the stay, for which reason its collection will be required on the date of arrival according to the age of each person housed.

GUARANTEE, MEANS OF PAYMENT AND INVOICING OF THE RESERVATION

To guarantee the reservation, you must provide your credit card details, through a secure platform, which complies with international security standards with PCI DSS certification.

Payment for the reservation will be made directly at the hotel, unless there is a cause of penalty for having canceled the reservation outside the established deadlines, or not showing up at the establishment on the agreed date of entry. In these cases, the corresponding amount will be charged to the card.

The client authorizes that once the payment is made if he wants an invoice, an electronic invoice will be issued, being able to revoke the consent at any time.

RESERVE CONFIRMATION

When we receive your reservation request, we will proceed to confirm it by email at the address you have provided us, within 24 hours, sending you an acknowledgment of receipt that will indicate the reservation number and contain the general conditions and, where appropriate, particular conditions of the contract.

COMMUNICATION WITH THE USER

Communications with the user of the tourist accommodation establishment will be carried out through electronic means, such as email, telephone, including instant messaging, so you must provide the active data at all times for this purpose.

RIGHT OF WITHDRAWAL

In accordance with current regulations, you do not have the right to withdraw from this contract for the supply of accommodation services for purposes other than serving as a home.

INFORMATION ABOUT THE RESERVATION, COMPLAINTS AND CLAIMS

CHECK-IN & CHECK-OUT

Check-in must be done between 3:00 p.m. and 10:00 p.m. and check-out between 8:00 a.m. and 12:00 p.m.

APPLICABLE LAW AND JURISDICTION

The interpretation and application of these conditions will be governed by Spanish law.

In case of conflict, without prejudice to submitting to what is imperatively established by law, especially when the contracting party is a consumer or user, waiving any other forum that may correspond to them, the parties expressly submit to the jurisdiction of the city courts. from Barcelona.
